This policy outlines how Sporty Magpie ("we" or "us") use personal information in the business.

Personal information that we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as “Order Information.” When we talk about “Personal Information” in this Privacy Policy, we are talking about both Device Information and Order Information.

How do we use your personal information?

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

- Communicate with you

- Screen our orders for potential risk or fraud

Sharing your personal information

Sporty Magpie will only use personal information, including sharing it outside the business, if we have a proper reason to do so, for example:

- To fulfil a contract with you to provide the product(s) that you have ordered

- When there is a legitimate business or commercial reason to do so, unless this is outweighed by your rights or interests

- When you have consented to your personal information being shared

We share your Personal Information with third parties if we have a proper reason to do so, and this is normally for the purpose of fulfilling a contract to provide you with the product(s) that you have ordered. We may also share the Order Information with our suppliers. We will not share any personal information with a supplier unless it is for the purpose of order fulfilment.

We will never sell or lease your personal information to third parties. We will not share your information with any other third party without your consent except to help prevent fraud, or if required to do so by law.

Do Not Track (DNT)

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Your Rights

If you are a European resident, you have the right to understand and access the personal information that we hold about you. This will normally be free. You have the right to ask that your personal information should be corrected, updated, or deleted. If you would like to exercise this right, please Contact Us.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred and stored on computer servers outside of Europe, including in Canada and the United States.

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. This is to comply with applicable accounting and/or legal rules regarding the requirement to keep financial records for the Sporty Magpie business.

Our policies for children

We appreciate the importance of taking additional measures to protect children’s privacy. Sporty Magpie does not intend for this Site to be used by anyone under the age of 18. If you are under the age of 18 and intend to purchase goods using this Site, you must do so under the supervision of a parent or guardian. You must be over 16 to place an order with us. We do not intentionally collect or maintain data about anyone under the age of 13. Sporty Magpie does not sell any type of product on this Site that require age verification.

Changes

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review this Privacy Policy to stay informed of any updates. You will be deemed to have been made aware of, will be subject to, and to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted.
